1. Who we are

This website, jackthebarberusa.com, is operated by BluSky Brands USA LLC ("BluSky", "we", "us", "our"), a limited liability company with its registered office at 517 16th Street, Huntington Beach, CA 92648, United States. BluSky Brands USA LLC is the exclusive United States distributor and brand representative for Jack the Barber, and is the seller of record for all orders placed on this site.

2. Acceptance

By browsing this site or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy and Refund Policy, each of which forms part of these terms. If you don't agree to them, please don't use the site.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet that requirement and that the payment method you use is your own.

4. Accounts

If you create an account, you're responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly if you believe your account has been used without your permission.

5. Products

We work to describe our products and display their colours and packaging accurately, but we can't guarantee that your screen shows colours exactly as they appear in person, and packaging is occasionally updated. Product descriptions, ingredient lists and usage directions are provided for general information. Our products are cosmetics and personal care items; they are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Always read the label and follow the directions, and discontinue use if irritation occurs.

6. Availability

Stock levels shown on the site are our best current information and can change between the moment you add an item to your cart and the moment you check out. If an item you've ordered turns out to be unavailable, we'll contact you and refund it.

7. Pricing and errors

All prices are in US dollars and exclude sales tax, which is calculated at checkout where applicable. We may change prices at any time before you place an order. Despite our efforts, an item may occasionally be listed at an incorrect price or with incorrect information. Where that happens, we reserve the right to cancel the order and refund you in full, even if the order has already been confirmed.

8. Orders

Your order is an offer to buy. Our order confirmation email acknowledges that we've received it, but a contract is only formed when we dispatch the goods. We may refuse or cancel any order, including where we suspect fraud, where quantities appear to be for resale, or where an error of the kind described above has occurred.

9. Payment

Payment is taken at checkout through our payment processor. We don't store your full card details. By submitting payment information you confirm that you're authorised to use the payment method.

10. Shipping, returns and refunds

Delivery is governed by our Shipping Policy, and returns and refunds by our Refund Policy. Risk of loss passes to you when the carrier delivers the goods to your address.

11. Intellectual property

All content on this site — including the Jack the Barber name, logos, product photography, text and design — is owned by or licensed to BluSky Brands USA LLC and its licensors, and is protected by intellectual property laws. You may not copy, reproduce or use it commercially without our written permission.

12. Acceptable use

Don't use this site for any unlawful purpose, to interfere with its operation or security, to scrape or harvest data from it, to impersonate anyone, or to transmit malicious code. We may suspend access to anyone who does.

13. Third-party links

The site may link to third-party websites we don't control. We're not responsible for their content, products or practices, and a link isn't an endorsement.

14. Disclaimer

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the site will be uninterrupted or error-free.

15. Limitation of liability

To the fullest extent permitted by law, BluSky Brands USA LLC and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or any product bought through it. Our total liability for any claim will not exceed the amount you paid for the product giving rise to it. Some jurisdictions don't allow these limitations, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify and hold harmless BluSky Brands USA LLC against any claim arising from your breach of these terms or your misuse of the site.

17. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

18. Changes

We may update these terms from time to time. The version in force is the one published on this page when you place your order, and the "last updated" date above tells you when it last changed.

19. Severability

If any provision of these terms is found unenforceable, the remaining provisions stay in force.
